If you have sex with a woman who is passed out, you're raping her whether you greeted her first or not.

This has got to be the most ridiculous thread ever made on these forums. Can a mod please lock this BS or at least move it to OOT? I don't want to see this rape apologist BS.

Having sex with a woman who is excessively intoxicated is not it. That is morally wrong. Wasn’t he married?

I hope our AD is smarter in giving advice to our student athletes.

Two individuals testified that she performed sexual acts on him without his verbal permission while he was in an intoxicated state. Should she be charged?

What is the evidence that she was passed out while they were engaged in sexual activity? There is none. The only outside witness says that she was making advances on McClemore.

Your name-calling doesn't change the egregious injustice in this case.

Ya, don't get drunk is what the AD should be saying. It sounds like both the man and this woman in this case made the wrong decision of getting drunk.

One was the rapist, the other was Covington, who didn't actually say what you're saying he did. He said he thought he saw her arousing him, but they were under a blanket & he couldn't really see, and it was like 4 a.m., and he'd been drinking heavily, and also McLemore was his buddy.

Also, if you're going to consider McLemore as a witness, why not consider the victim who said she literally tried to escape as she flashed in and out of consciousness while being raped?

We covered this earlier, but there was witness & photographic evidence that she was blackout drunk and passed out around 2 a.m. There was also McLemore's testimony that he and the woman didn't speak prior to or during the intercourse. Only a complete bonehead would believe she was capable of giving consent.

Covington "guessed" but couldn't see. If you saw movement beneath a blanket where your friend was with a passed-out woman, your brain probably wouldn't process that he was about to rape her, either. Or maybe it would and you'd just get up and leave, which is what Covington did.

Covington might have actually been guilty of an accessory crime had he admitted he saw his friend about to rape the woman and chose to let him.

His testimony per yourself is that "he [Covigtons] thought she was arousing him [Mclemore]". This suggests that she wasn't unconscious during the sexual activity which nullifies a huge part of the prosecution.

And yes, I would usually discount McLemore's testimony, but there are parts of his testimony that are bolstered because they are verified by Covington. Whereas the testimony of the woman doesn't get outside validation.

McLemore was also drunk. Being drunk and having sexual intercourse does not = rape. You seem to think this is a magical equation. The photographs of her being drunk does not support the assertion of rape.

Did Covington say that she was passed out? If so, then my whole view of the case changes.... based on what you said earlier, Covington wouldn't have "guessed" that she was performing sexual acts on McLemore unless she saw her conscious. I doubt what you are saying is the actual testimony, but if true then I will change my conclusion.

Yes, being drunk and raping someone is still rape. It's up to each and every man to be accountable enough for himself to not rape women. I mean that's like baseline stuff, not really a huge ask.

A person being drunk and having sexual intercourse does not mean they were raped.

That is the essence of the argument based on the evidence presented.

I've been drunk and had sex. I've never been passed out and have someone rape me, nor have I ever raped anyone whose been passed out.

The latter is the argument of the prosecution. There is no physical and/or testimonial evidence to support this.***

The former is the argument of the defense. There is no physical evidence to support, but there is testimonial evidence to support.


***pictures of someone being passed out 2-3 hours before the incident is not evidence that the person was unconscious when sexual activity commenced. In fact, there is testimony that McClemore himself was heavily intoxicated himself. Using your logic, that means that he could have been unconscious when the woman tried to "arouse him" (per Covington) which means she should be charged.
