Lanning confirmed at Big Ten Media Days that he expects DB Daylen Austin to play this season while he awaits his trial in February.

I stated this in the other thread, but the running away from the scene is probably the most concerning part of all the details.

I cannot for the life of me figure out why this is the hill the Lane County DA is choosing to die on. Camera footage, evidence collected at the scene, toxicology of the victim and criminal history of the victim, Austin’s testimony, etc. Everything matches and points to him doing nothing wrong. Austin has no criminal record and by all accounts is a good human being. This reeks of a grandstanding DA.

I was really suprised the grand jury decided it should go forward.

Don't live in Eugene so don't know much about the DA but this seems like a reach.

I'm not a lawyer so not implying anything. Seems pretty clear, in fear Austin left the scene of the accident, big thing, I get that. There should be consequences for that for sure, but a trial?

With the postponement of the trial and the reasons for the postponement as reported in the news media, let me just repeat for the 1,0000th time this is a fascinating hill for the DA office to die on. I get wanting to appear like you aren’t just sweeping things under the rug because it involves a football player, but with everything that’s been reported and is public record, we’re well past that stage. Now he just looks like he’s digging in because Austin is a football player. There are a lot better things the DA Office could be doing with their time and resources.

Given what many believed at the time and what has come out, charges should never have been brought. Austin has a clear case of self-defense/fear for his life given the supposed victim's mental health and drug issues.

The weird detail in this is why Austin went back after the initial encounter. Possibly to confront him about the winshield?

I think it's instinct to think that there's this crazy homeless drug addict and that his life his somehow less valuable because of that. It's not and should be investigated. That said, it's also a reasonable reaction to be scared to someone waiving a hammer at you. Thus, why I wonder what part of the fact pattern is missing here such that the DA is pushing forward.

One of the problems with the grand jury system is it isnt a mini trial. Its having a group of people, based only on the prosecutor’s presentation, make the call that it might be able to move forward. The burden of evidence is lower than the main trial as well
