That’s a bad look, I wonder what his punishment will be and how this could affect the 2026 season. He’s lucky he didn’t kill someone, he needs to get help.

He backed into another vehicle and the cop assumed he was drunk. They didn't give him a sobriety test. Doubt they get a conviction by serving his defense reasonable doubt in a silver platter.

They didn't give one, or he refused one?

I find this extremely hard to believe. With Oregons soft on criminal policies and weak DA’s as soon as the charges crossed the DA’s desk they would have been tossed. You either fail a FST or refuse one in order to be arrested and charged. Even if a suspect is incapacitated/unable to perform a FST for whatever reason LE will request a warrant for a blood draw and wait for the results to come back before a DUI charge and arrest. Even with a refusal they will bring in a DRE (drug recognition expert, yearly certification and must maintain a 97% correct evaluation assessment) for the purpose in securing a warrant for blood draw and testimony in future court proceedings.
